Andrew Hatnay
Partner
Andrew Hatnay is a partner in the Koskie Minsky Pension and Benefits Group and advises clients on legal issues affecting pension plans and employee benefit plans. He has expertise with pension plan mergers, wind-ups and pension and benefit issues that arise in merger, acquisition and bankruptcy situations. He is also a litigator and represents employees, unions and pension funds in insolvency and bankruptcy proceedings before all levels of court, including the Supreme Court of Canada.
Andrew has advanced the interests of employees and retirees in the insolvency proceedings of Eaton's, Dylex, Cotton Ginny, Irwin Toy, General Chemical, Hollinger and many other companies, and has assisted in solving the pension problems associated with the restructurings of Algoma Steel, Stelco and Ivaco. Andrew is currently involved in representing clients in a number of auto-sector bankruptcies and restructurings.
He was successful counsel in the precedent-setting case of Re T.C.T. Logistics, where the Supreme Court of Canada held, among other rulings, that a collective agreement remains in force in insolvency proceedings.
